The Way Forward for Peace in South Sudan

May 25, 2015(Nyamilepedia) — We, the Equatorian community in the United Kingdom, met in Manchester, England on 18th April 2015 and discussed the ongoing conflict in our beloved country.

We appreciate IGAD and the international community’s relentless efforts in finding a peaceful solution to the conflict in South Sudan. We note with great sadness that the ongoing conflict has caused untold suffering and looming humanitarian disaster to our people in the country. We are also deeply disappointed that the parties to the conflict (GRSS and SPLM-in Opposition) have continually violated The Declaration of Principles and Cease Fire Agreements already reached.

It is our conviction that the solution to the current conflict does not lie in simple power-sharing modalities as trends of the ongoing negotiations indicate. However, we strongly feel that addressing the root causes of the war and in particular the inclusion of all stakeholders in the peace process – as stipulated in the IGAD Agreement of the 9th May 2014 – will bring meaningful, sustainable and just peace to the people of South Sudan.

In this document, we urge IGAD-plus and both the negotiating parties to seriously consider our assessment of the problems and the humble solutions offered. We have focused our attention on two main contentious areas: (1) Security, and (2) Governance.

  1. SECURITY

The ongoing civil war has adversely caused severe insecurity across the country. Many citizens have been forced to leave their places of origin in search of peaceful settlements in relatively unaffected cities, towns and villages in Equatoria Region. The influx of these Internally Displaced Persons (IDPs) has significantly impacted on relations between indigenous population and IDPs as the latter arrived fully armed. Also, their presence and behaviours have consequently affected security situation in the area. The vices of insecurity, human rights violations, absence of rule of law, land grabbing and occupation, destruction of crops and so forth become rampant. Besides, corruption and nepotism practised by key government officials including those in law enforcement agencies cause mayhem to ordinary citizens in Equatoria. This is because almost all the security sector in South Sudan is predominantly controlled by one or two tribes.

As Equatorian Community in the United Kingdom, we strongly urge IGAD-Plus and the two warring parties to take into consideration the following points:

  1. Ending the War:

The negotiating partners are hereby urged to negotiate in good faith in order to settle the conflict amicably. The voices of Equatorians in the Diaspora, rebel- and government controlled areas must be taken into consideration. If given opportunity, Equatorians in the UK are willing to send their representatives to take part in the forthcoming peace talks.

  1. Reforming security sector:

The composition of the security services in South Sudan is to be restructured to reflect ethnic diversity in the country. The ten states should be allowed to employ and manage their own organise forces (e.g. police, prisons and game wardens). In addition, there must be strict control of arms; and all military installations/sites must be relocated at a minimum distant away from civilian areas.

  • The military structure during the interim period:

It is proposed that the structure of the armed forces be reformed into the following four commands:

  • A national command with equal representation from the three former regions of South Sudan, namely Equatoria, Bahr el Gazal, and Upper Nile. The leadership command of the national Integrated Armed Forces shall be representative of the three regions.
  • Equatoria Division: commanded and composed of soldiers from Equatoria;
  • Bahr el Ghazal Division: commanded and composed of soldiers from Bahr el Ghazal; and
  • Upper Nile Division: commanded and composed of soldiers from Upper Nile

In order to ensure that military power is not concentrated in the hands of one tribe or region to the detriment of the rest, it is important that future security arrangements and armed forces be divided into regional commands, with each of the three former regions of Equatoria, Upper Nile and Bahr el Ghazal take control of their respective security forces (Figure 1).

This structure for reforming the national army should be implemented during the interim period.

Currently, the army is dominated by only two ethnic groups. Our country would not have been plunged into this devastating war had recruitment into national army was handled on the basis of proportional representation of all tribes across South Sudan. As a matter of fact, the ongoing war initially started along ethnic dimension – Dinka vs Nuer- whereby revenge killings resulted in tremendous loss of lives from both sides. To make sure this scenario does not repeat itself in the future, the formation of the new national army and security services must be formed on the basis of proportional representation among the three regions of Equatoria, Upper Nile and Bahr el Ghazal.

  1. Return of all Internally Displaced Persons (IDPs) to their places of origin:

As soon as the ongoing war ends, all IDPs and their cattle must return to their places of origin. Their presence in Equatoria causes significant insecurity and intercommunal conflicts between IDPs and the indigenous communities; left unresolved this could ignite future conflicts. IDPs have contributed adversely in community relation in South Sudan, especially in Equatoria. This is because most IDPs are involved in land grabbing issues, conspiracy to out-manoeuvre the indigenous population, oppressed them and permanently occupy Equatorian land. There is also the irreconcilable lifestyle difference between pastoralists’ ways of life of IDPs as compared to agricultural lifestyle of Equatorians.

  1. Land issues:

Land laws should be reviewed to address respect for other people’s land. Acquisition of personal property(ies) including land must be carried out in a rightful and legitimate manner; by seeking consent of the rightful owners.

  1. Human rights:

We commend the efforts of the African Union Human Rights Commission for investigating possible human rights abuses in South Sudan. Furthermore, we appreciate the efforts and determination of the former President of Nigeria, Gen. Olusegun Obasanjo, for conducting investigation into atrocities committed, human rights violations, destruction of properties, other war crimes and their perpetrators. We therefore urge the chairman of IGAD to ensure the release of this report with immediate effect.

We believe that this report holds the key to bringing those implicated in committing the atrocities and other war-related crimes to face justice. We also urge IGAD plus to follow through the implementation of all recommendations in that report.

  • Implementation of the UN Security Council sanctions

We thank the UN and its various agencies for their humanitarian support for the suffering people of South Sudan, the IDPs, those in UNMISS compounds and those in neighbouring countries.

We would also like to join other concerned members of the international community in supporting the UN Security Council resolution 2206 (2015) for immediate imposition of targeted sanctions against individuals and entities who are seen to be obstructing the peace process, and those responsible for committing war crimes.

  1. GOVERNANCE

The governance problems facing the Republic of South Sudan can be summarised as follows:

  • Tribal domination of the country by one tribe: The three organs of the state (judiciary, executive, and legislation) are dominated by the same tribe; the security organs are also dominated by the same tribe; and the country is slowly moving towards tribal hegemony.
  • Human rights abuse: The killings of civilians are not addressed; there is rampant injustice with impunity.
  • Corruption: The citizens are witnessing looting of state resources; and there is lack of accountability for loss of those national resources.
  • Structure of states in the Country: The structure of the state needs to be reviewed to determine the viability of the current ten states versus the 3 former regions (Equatoria, Bahr el Ghazal and Upper Nile), and the recently proposed 21 states by SPLM-IO.
  • Type of Leadership: The limitation of current leadership is the focus on positions, and ruling by decrees. We need to identify the systems of Federalisms that best suits independence of each regions / state in the country.

The Solutions

  • Federal system of Governance: Federalism should be adopted as the system of governance in South Sudan.

Given the ethnic diversity and divergent political aspirations, coupled with vastness, remoteness and poor infrastructure in the country; the Republic of South Sudan (RSS) needs to adopt a new model of governance – FEDERALISM.

Under the present government, power and resources have been concentrated at central level leaving states and counties with limited abilities to exercise real local governance; to influence development, enforce laws and maintain security. Given that the current status quo is not working well, and therefore unacceptable, the interim period is a good time to pilot Federalism, which will be ratified in the permanent constitution.

We, the Equatorian community in the UK, add our voice to the call for federalism. This is because a genuine federal system will enable separation of powers between levels and organs of the government. This needs to be included in the peace agreement to be implemented by the proposed interim government of national Unity.

  1. Develop and adopt a shared vision for South Sudan:

As South Sudan is a multi-ethnic, multi-cultural, multi-lingual and multi-religious country, its existence as a just, united, peaceful and prosperous country will depend on recognition of the people of Equatoria and other ethnic minorities as equal stakeholders in the forthcoming peace talks. Strong foundation for nation building in South Sudan will only be realised if our leaders consider shared vision and responsibility for all the tribes in the country.

  1. Inclusive Government:

All the 64 tribes must be represented in all the national institutions (Executive, Legislature, and the Judiciary). Proportional representation of all minority groups must be clearly outlined in the future constitutional review.

  1. Corruption & employment policies:

New employment policies need to be developed and adopted that will ensure adherence to equal opportunities in all government institutions. Laws against discrimination need to be enacted and there should be transparency in recruitment and appointment of public service officials, and the security sector. Employment must be based on merit where the best person for the job must be recruited.

Financial probity and accountability for the national resources must be instilled in all Government Institutions. This should be legally enforced.

The International community, including TROIKA, EU and other countries must exercise their influence to ensure that the financial support they give to the Government of the Republic of South Sudan are properly accounted for. As Diaspora community, we contribute through the tax system in funding the financial aid to South Sudan, and therefore we too demand assurance that our tax payers’ money is being used for the intended purpose.

  • The Presidency:

Given that the current conflict has directly implicated President, Salva Kiir Mayardiit and former Vice President, Dr Riak Machar, – both leaders have failed the nation; hence they should step aside from leading the Transitional Government of National unity (TGNU) during the interim administration. A new leader must be selected from one of the minority tribes in South Sudan, as a neutral figure to bring South Sudan together. Equatoria has a track record of unifying the people of South Sudan and we therefore recommend an Equatorian to be tasked with the responsibility of leading the country during the interim period as President.

To avoid the issue of ethnic domination of the country in the future, consideration should be given in the permanent constitution to ensure that no President of the country serves more than two terms or 10 years. Term limits for the President must be 2 terms of 4 or 5 years, which cannot be changed by parliament, but by a referendum. Secondly, the presidency must rotate among the three greater Equatoria, Upper Nile and Bahr el Gazal regions.

  • Elections: There should be free and fair elections after the interim period.
  • Chiefs: The traditional role of chiefs should be restored and recognised in the constitution. It has to be made clear that the chiefs are accountable to the people rather than the Government.
  1. Constitution:

The present constitution of South Sudan was written by the SPLM within the framework of the CPA and do not represent the principles and norms of an independent state. We therefore condemn it and call upon the forthcoming interim government to organise a constitutional conference for all stakeholders to review it and come up with a permanent constitution that is grounded on certain principles and norms agreed upon by all South Sudanese to form the backbone of governance and the supreme laws of an independent South Sudan.

In conclusion, we welcome the expansion of IGAD to IGAD-plus and we hope that you will now try to deliver the much needed peace for the suffering people of South Sudan. To realise this, we call upon the inclusion of all stakeholders, especially Equatorians in the forthcoming negotiation.

Visited Maluth after rebel were defeated really bad…I can not believe my eyes what I have seen many many dead bodies on the ground..some have no shoes, no legs, heads cut off and every where I look are the bodies and wounded Lou Nuer primitive thinkers of white Army.. and specially most are my nuer people primitive thinkers of Nuer white Army:
Here is the real truths on civilians and real SPLA existing, many are wounded and several killed. While on the primitive thinkers of Rebel Forces side, entire three [3] Battalions which were reignforcing Riek Ebola Rebel Force Comrades on a march to Paloch is wiped out by the SPLA MAINSTREAM JUBA ARMY in the battle of Tukthiang and Maluth.

THE POWER OF THE LION KING IS FEELINGS BY THE RIEK EBOLA AND RIEK EBOLA KNOW THAT HE LOST THE WAR ON THE GROUND…IT IS JUST MATTER OF TIME AND PEACE INTERESTS. MAR MY WORDS..

Please Note that this is not a joke and stupidity but the reality… here are the consequences of war and suffering: Please read below the facts and reality event that are happening now in Upper Nile and Unity sstates. This is my eye witness account no jokes and no laughing please my heart was broken when I see these dead and wounded young Nuer people..

Please read this carefully:
Here is my eye witness started: While driving passed by we found 85 dead bodies 3 wounded with red thin cloth tied around their heads
Among those killed and wounded, many are as young as age 9 to 24 years old. In fact one of those wounded all legs broken was begging us for help and he said beg that in Nuer language“We are One People and that SPLA Juba should not attack Malakal to avoid those few weak remain wounded Soldiers of our Nation from being kill. Please SPLA JUBA must have mercy on it own citizens, please please please!!.” He continued crying out loud for help. He said to us he and most of his dead men are from Lou Nuer villages and areas!

Later we put this young wounded man Inside MEDICAL CAR, owned by the Doctors without Borders team of doctors and nurses who are taking risk to save life. Now he is well but both his legs are cut off to save his life.

I always tell Nuer on this Website, that Nuer with others NyamNyam or Jur are nothing than Dinka with her Cousin Nuer plus others NyamNyam, could exceed with what they doing by all means.
Now, in case, people like GatNor still not heard about malakal being captured and Johnson Olony run away with only underwear, whom he very lucky, not to be castrated by sector general Gony Bilieu.
This time around Olony will run for his dearly life, instead to liberated the lands he fighting for. Land will be always for Apadang Dinka.

The war has been declared on Nuers on tribal lines. What is the use of hiding behind the uniforms of government of South Sudan using its resources and hiring mercenaries if its not because of you Jaang and your Nuer Sell-Out are nothing but cowards terrorist who kill innocent unarmed women and children. To me you are no different from those Nazi-Germany cowards who terrorized the German Jewish during World War II. Mabior Garang of SPLM-In Opposition clearly said this on behave of liberation forces of the SPLM/A-In Opposition. He said the army must be reformed so that its loyalty is not on tribal lines to prevent any more ethnic cleansing. Had South Sudan had a national army it could be effectively used to deter tribal disputes between neighboring tribes but SPLA-Juba is currently using the nepotistic and the so called national army to advance its tribal agenda. Forget the idea of Nuer-Jaang and Jaang-Nuers, it serves no purpose in a modern society where a man’s worth is not value by his ethnic linage but by what he or she can contribute to the table. When you go to your villages if such a system is what you enjoy then stay in the village where you fit with your village culture and mentality. Deng II, how many Nuer Sell-Out have sacrificed for the so called Jaang kingdom and are six feet rotting in the dirt as victims of their own kingdom? If you really believed that –“Nuer with Dinka Descendant will quit Nuer tribe and back to their root” then you need to go check and confront whoever fed you with such a lie. The way things stand some Nuers will not want nothing to do with Jaang regardless of your own statement I have just quotes. I mean a total divorce where relations to Jaang will be disowned without regrets. This also is a right one can exercise on their own behave and you Deng II can do jack-shit about it.

You may think that South Sudan is not belong to Dinka. That is how wise people think, but most Dinka politicians believe that this government belong to them. They think they deserve it. They even think they have the rights to do so. It is very sad. One of them told me that Dinka have the rights to rape, loot and kill to defend this government. He said that Dinka fought for South Sudan. It is hard to deal with such narrow minded people like him.

When I told this innocent soul that my brother was killed in the battle field. My family gets zero from this government. My family and I we do not mind it because my brother paid the Independence of South Sudan with his blood. As a family, we will always remember him as a hero just like other South Sudanese heroes whose blood paid for our freedom we are supposed to enjoy in South Sudan today but the power and the greed robbed our country.

Proudly, I said to this fellow that all South Sudanese people deserve respect and dignity because everybody fought during the war so we do not expect anybody to rob the wealth of South Sudan because he or she deserves it. All South Sudanese deserve it. The fellow looked at me and apologized for being so ignorance and reckless in his comments.

South Sudan belongs to all the tribes. We just need to learn how we can respect one another regardless of which corner or tribe they come from. All the tribes in South Sudan feel the pain if one of them is killed. This war is not between Dinka and Nuer. All the military soldiers in the government of South Sudan belong to all the tribes. They all kill each other when they are fighting with the rebels. The same with the rebels other tribes are on their side fighting the same government. If we are really human, we should be able to feel the pain if one of us is killed. As human, we should never celebrated when our brother or sister is killed. If we do celebrate our loved ones death, then something is terrible happens to our society. Let us be human and feel each others pain.

Such a proposal is not only risky but also entirely disastrous,in a sense that it ignites regional break away and since Upper Nile is naturally endowed with oil ,and therefore, breaks away with its resources,hence regional disintegration and no more S.Sudan.This is not an ideal method of resolving this complex conflict but we need to at more congruent approach and ever lasting solution,so keep trying.Well tried brothers.

My problem to Equatoria people is they ignore position they are holding in the government. Now look they write letter copy SPLM IO and South Sudan Government plus Equatoria governors, who are those Governors with out Government of South Sudan? and who are those Equatoria demanding presidency seat during Interim period? South Sudan is now divided into warlords, SPLM IO, SPLM G10, SPLM Juba and SPLM Dc all these happen because of failed vision of SPLM why creating small sections? instead you should revise the vision and change its name to South Sudanese party. Equatoria are fighting what i don’t understand anyway they always do because of cowardice even in front line they say maal da kuoish mayi (this place is good for me). Now it seem opportunity for Equatoria to grape this position? No Either Kiir or Riek will rule this country no way out.

To be honestly speaking the SPLA MAINSTREAM JUBA ARMY COMMAND can not operating as this stupid article proposes. Because there are many many Nyageets and self servicing leaders who can hijack the COMMAND LINE as history witness it.
Because there are too many Nyagats who are loyal to their tribes than thier own beloved country of South Sudan . These Nyagats are known in history as back stabbers and collaborators and Tribalism inside them.

Now In Juba the General Command Center is run and operated by The SPLA MAINSTREAM JUBA ARMY Nationalist citizens.
To be honest now like we have seen many rebellions many times before, any one any Nyagats are free to rebellion and formed his or her own militias but the POWER OF THE LION KING can always be there and always be there whether like it or not. It is just matter of fact and reality event.

Anyway nyam nyam, you can write many press release articles as much as you can but the Lion King Nationalist citizens are clearing out the Nyagats in Jonglei and Unity and Upper Nile states. Whole Equatoria is just under the watchful eyes of Nimule militias, New Site militias, Yei militia and unlimited number of man power supply which are the part of the Lion King Nationalist citizens.
These Nationalist citizens of the Lion King are armed to the teeth and ready to crush any militias come In their way in Whole Equatoria whether like it or not.

For your information do you know that equatoria is the safe heaven for dinkas if you bring war here where will get water from where will show you benye (boss) from. pretending to stay in equatoria and living your home land undeveloped by revenging to other families and the same culture you bring to equatoria land killing of innocent people at night grabbing lands. and this is the behaviour you need according to your statements or article comments. Please give a powerful ideas and suggestions about everlasting peace in country and amongst the communities in the south sudan. Not we killed nuer we captured this and that bolabola things.

peace lover you right brother, I always told so call themselves Equatorian. the equatoria region have more than thirty tribes in equatoria to make equatoria as tribe is wrong and stupid that why I three regions in south sudan, anyone or groups of people they claim any region to be independent state in south sudan but it will not going to happen in the watch of the free lions and the SPLA national army in south sudan, the region of south sudan should be rename as Equatoria as whole or Mangalatoria region of south sudan and forget about three regions.

we already knew the anti dinka or Danish people in south sudan as whole,in the future south sudan should be one region not three any more, the division of south sudan to the three regions cussed tribalism and anti one tribe as they enemy of all other tribes.the mistake already made by our leaders to keep south sudan as it’s, they supposed to abolish the old sudan system of three regions and tens states and form one region in south sudan know as the Equatoria region of south sudan and divided in to 29 counties, each county have what I call CEO the county’s executive officer.

Most of the national politicians on the side of Juba faction including the council of Jaang criminals and the Equatorian governors operating and taking advantage of tribal divides. The same politicians also try convincing those citizens sitting in the dark about their hidden agenda that they are not exploiting situations on tribal lines. When will people acknowledge that yes there is a clear tribal dimension to the whole civil war from day one Acknowledging this would mean South Sudan has identify the problem and also they can chose to continue with tribal rhetoric or do the abandon it. This is a fact South Sudanese can not hide from forever. They have to face it sooner than later. The three region are part of the problem and must be consider as either affect on tribal lines in order to steer away from such once identified. if you look at the region of Bar El Gazal it is almost like a different country within South Sudan where its problems in are not as in other region and the question is why? The states of Bar El Gazal shares common grievances with other two regions of Upper Niles & Equatoria a constitutional violations, economic down turns. Upper Nile has every problem you can think of in South Sudan. Now come to Equatoria lawlessness alone is one of the main concern in Equatoria and it is unique because the Equatorians are deeply affected and in this they feel targeted. In addition, impunity land grab has become a common practice in Equatoria and that too has its sets of unique circumstances in comparison with the regions of Bar El Gazal and Upper Nile. Here it is obvious South Sudan need a different applicable solution for each problem in each region. Therefore studying what sort of problem is facing each region would easily isolate, identify specific problem in order to invent a possible solution to solving each region’s problem. The 3 region do not have exact problem and would not need the same remedy for treatment and as such they cant be generalized. Upper Nile is completely destroyed now when the other two regions are somewhat life continue and its business as usual.. Shitty business but that is what South Sudanese consider normal since they don’t know any better in terms of their constitutional rights.

Don’t be an idiot to write a vision less meanings on some one article instead to give an idea. you look like person pretending to know more but has nothing in mind to comment. it has come to my understanding that south sudan is lead by vision less person and it has indicated that you Abuchook (dinka) has no vision to give an idea to help president instead leading the president nowhere near to his legitimate. it looks like dinka is in the image of human being but in actual sense is not human being. they have no knowledge of leading and management of human being e.g how can you comment on some once article by giving a lies about meliut and malakal have you been dreaming or that is imagination. try to give something that readers enjoys whiling reading on you comments. you are stupid and you will remain stupid and lead rest or uneducated people on you on way and the end you finish nothing.

Nuer ,Shilluk and Some Dinkas , who have rebel minds, will regret later after two years fighting madness war, President Kiir , is a permanent man he don’t chance like Dr: Reik machar , Wen Mayardit liberate this country from Reik and Olony ,because they were Arab militias, and now pretending that are food liberators . They were Bashir slave and even now they will remain Kiir slave . The so called rebel fighters now ,,,,were terrible enemies of SPLA during liberation war , but CPA force them to come ,like Dr. LAm and Dr. Reik . This country would not be stable because of Nuer culture of greedy and calling Dinka properties their properties. Nuer brothers do not like to do their own business , they call other people effort their effort. Now in Great upper nile , they have taken all other tribes cattle and killed their disable , it like criminal want to rule the country , through bandit high way threat. . They don ‘t thinks
if Nuer can rule this country at this time ,let them keep away from looting and burning of country properties . shame on Nuer rebels ,praise to Nuer in government.
