SPLM/A Acting Representative to the United Republic of Tanzania Accuses President Salva Kirr of Violating the Peace Agreement Over 28 States;

Oct 7, 2015(Nyamilepedia) — SPLM/A office of the Acting Representative to the United Republic of Tanzania condemns the flagrant violation of the compromise peace agreement by Mr. Salva Kiir, the incumbent president whose term expired in July this year.

Quoting the transition constitution of South Suda [2011], Amb. Peter Oyoyo Kleto,calls on the government of the United Republic of Tanzania, IGAD, TROIKA, EU, China, Russia and other stakeholders across the globe to take measures against any imposition of unconstitutional states in the world’s youngest nation.

“unconstitutionally decreeing the creation of 28 states in the country, I want to inform the government of the United Republic of Tanzania, the IGAD, Troika, EU, China,Russia and all other stakeholders across the globe that the decision taken by Salva Kiir has no legal or constitutional basis whatsoever and therefore should be condemned and we request him to immediately revoke his decision in order for the peace to be implemented in letter.” Said Peter Kleto, who represents the SPLM/SPLA in Opposition in Arusha.

Kleto reminds the sympathizers and supporters of SPLM/SPLA that the movement does not fight to establish more states but to procedurally introduce federalism and other reforms in the country.

“I want to inform our comrades, friends and sympathizers that SPLM/A under the visionary, charismatic and democratic leadership of His Excellency Dr. Riek Machar Teny Dhurgon is not fighting for more states to be created, but for a federal system of governance based on the former colonial districts which have clear boundaries, unlike the illegal decree by Salva which created clan and tribal types of states.” Kleto said.

South Sudan’s transitional constitution which is overruled by the new peace agreement demands that any creation of more counties or states must be approved by at least two-third majority of the Council of Ministers and introduced through referendum.

“Also the transitional constitution of South Sudan 2011 article 162 is very clear because it says the number of states shall remain ten and names,boundaries cannot be altered except by the decision of council of states, now where did Salva Kiir get his powers from?. This is something that he should have raise during peace negotiation and still he has a chance to bring on the table during the drafting of the permanent constitution.” Kleto explains.

Kiir on his part, however, dictates that the 28 states that he creates must be implemented within 30 “working days” by the current ten governors, who are literally sacked by the creation of the new states.

Opposed by many South Sudanese, political parties and the international community, the decree violates the recently signed peace agreement and therefore must be reversed, as the critics say.

Kleto explains that creation of 28 states is a continuation of dictatorial tendencies which the opposition bitterly opposes.

“What we are seeing is just an expansion of states but same system of governance where Salva remains as the only power in the country and this is not the country we aspire to have.

“SPLM/A under the visionary leadership of Dr. Riek Machar Teny aspires for a country where all tribes will have equal treatment, a country where democracy is the order, a country where people elect and through democratic election remove their leaders, a country where conflict is considered a thing of the past, a country where love and tolerance is embrace, a country where all tribes are united as one family and with love, this is a South Sudan we wanted.” he explains.

Despite criticism, Salva Kiir orders that his decree must be implemented. The president convened the governors in Juba two days ago to update them on the abrupt changes.

President Salva Kiir removed six governors in mid August this year and appointed new governors to take up their positions last month, however, to their surprise the ten states are now dissolved as Salva Kiir prepares to reconstitute new states and their governments.

To be a rebel like you it is in which constitution? cry to your masters will not change any thing, what soever the cause make my word.

They are poor,weak and greedy of power. I am proud of government,please keep secret because no matter how damage Riek Machar had done.
