June 12, 2016(Nyamilepedia) —– The Nuer community in the United States of America is dismayed and terribly disturbed by the position recently taken by the South Sudan President in attempt to find ways to averted the desperately needed justice to brought those who were accused of committed war crimes against humanity during the two years civil war in South Sudan to be subjected to trial as a mean to ensure justice is served. The community condemned in the strongest terms possible the op-ed, which the New York Time published earlier last week. We the victimized Nuer community fully support the implementation of August 2015 peace Agreement to end this vicious war and to hold accountable, convict and prosecute the masterminds of Juba genocide, Greater Upper Nile, and other States in South Sudan.
In the IGAD Peace agreement on South Sudan’s Transitional Justice and Accountability, Chapter V. Article 3.2.1, it is stated that “the Hybrid Court on South Sudan shall have jurisdiction because of the crimes committed such as genocide, crimes against humanity and war crimes. It’s also stated on Article 3.5.1 that the HCSS shall hold accountable, convict and penalize those who planned, instigated, ordered, committed and finally executed the crimes against humanity.” Therefore, the Nuer Community in the United States is strongly appealing to the international community; African Union, US government and Troika to object the alleged articles from the office of South Sudan President and move forward for full implementation of Chapter V. transitional justice and accountability in the peace agreement.
Thus, it’s obvious that the only way to end this vicious war is to commit to bring those war criminals accused of committed these heinous crimes to trial as the best way to ensure justice is served. Otherwise, peace without justice will not ensure stability and peaceful reconciliation. An attempt to repudiate to handover the accused individuals to face trial is a complete a recipe to a future revenge and retaliation from the affected communities all over the South Sudan.
We urgently request the African Union and all peace partners to immediately start the process of Hybrid Court immediately as the required Transitional Government of national Unity has been formed. The consequence of the failure to implement the needed peace agreement will present the victimized Nuer Community with no choice, but to use other means to demand real justice. The Nuer Community has been more than willing to bring peace to our nation despite the suffering that was inflicted on its community members by no one else other than President, Salva Kiir Mayardit and his allies. As a result, the Nuer Community leadership is hereby warning President Kiir Mayardit and his allies that failure to implement the IGAD negotiated Compromised Peace Agreement will eventually obligated the Nuer Community to take other options to ensure justice is served.
In addition, the community is also appealing to JMEC, UN, US and Troika Countries to put a strong pressure on President Salva Kiir to revoke the unilateral declaration of tribal 28 States as this was created as intentional hindrance to the implementation of the peace agreement. The issue of IDPS to continue to live in harsh environment is also bothering our community and it should also be resolved by immediate transporting of those who are willing to go back to their respective States and rebuild their lives.
