THE PRIME MINISTER POSITION: WHO NEEDS IT NOW?
Sept 05, 2014(Nyamilepedia) — On 23 August 2014, the IGAD mediators have proposed and agreed to create the Prime Minister Position for South Sudan in the upcoming proposed Transitional Government of National Unity (TGNU) rounds of talks in Addis-Ababa, Ethiopia. Who the hell in the world is really crazy about IGAD’s proposed Prime Minister Position? Who says that the ongoing crisis in South Sudan is all about the non-existing and powerless Prime Minister Position in the Transitional Constitution of South Sudan? Did the former VP and the Chairman of the rebel Movement of the SPLM-in-Opposition (SPLM-in-OP) and all its affiliates or proponents have they agreed in the aftermath of any consultations if any at all, on the newly proposed illegal and unconstitutional Prime Minister Position? Frankly speaking, the proposed Prime Minister Position has been ultra virus or extra-jurisdiction of the aggravating situation in South Sudan.
POWERS OF THE PRIME MINISTER
Let’s assume that the war has been about the proposed Prime Minister Position, why don’t we have the red badge of courage to upgrade the war or to expound the war to the President’s position in South Sudan? What are the powers of the proposed Prime Minister Position? Is it a taboo or forbidden fruit for a non-Dinka to become the President of South Sudan? Is this proposal to confirm the alleged racist and pseudo-ultra-conservatism of Dinka’s demagogic and devilish presumptions that “They [Dinka] are born to rule and not to be ruled” and that “They [Dinka] are the “Chosen People” — by whom and for what? –that is by its divine rights, critical analytical and logical reasoning and reasonableness, sociological, epistemological, philosophical thinking and metaphysical theory still remain a myth to be demythologized. Let’s hypothetically assume that the ongoing war has been all about the President, what kind of a President that would be in the eyes of the stakeholders and the people of South Sudan?
We would like to become double advocates in this situation by reserving the roles. Let us assume that let Salva becomes the Prime Minister and let Dr. Machar, the smart, highly qualified and experienced statesman, visionary and diplomatic with the all the Presidential characteristics compared to Salva becomes the President, would Salva accept that empty nest position? We would like the IGAD mediators to know that the issue at end is neither about the President nor the proposed powerless, useless and hopeless Prime Minister Position. It is about rights of the people who have been purposely targeted for extermination, annihilation or genocide as a “final solution” in whole or in part. We would take our rights, and as the victims of 15-18 December 2013, Juba Genocide, we are hereby declaring to the world that we do not subscribe to any of the positions of the Prime Minister or the President, but we want our inalienable fundamental human rights as God’s given rights and internationally guaranteed rights under the UN Charter and international law to “all peoples” on the planet-Earth.
We have nothing to do with both Salva Kiir and Wani Igga as the illegitimate President and Vice President of South Sudan, respectively. We would want them to know that “let my people go” and they are determined and motivated to go through the exercise of the right to self-determination or through a political divorce as the people of Scotland would positively vote in a referendum on the right to self-determination on 18 September 2014 to exit from the UK after more than four hundred (400) years retrospect to the Union with the Kingdoms in 1763 or the people of the Greater Upper Nile would have to go by any means necessary.
We would like to sojourn to the tiny Island nation of Cyprus on the Mediterranean Sea that had divided itself into two mini-states and recognized by the United Nations as the Greco-Cypriots on the West side of the Island nation of Cyprus and the Turkish-Cypriots on the east side of the Island nation of Cypriots. We shall and we will go like people of Somaliland in Haragessa on the Gulf of Aden that have finely and greatly existed as a de facto state rather than a de jure state for the past 18-20 years and did and does mighty fine compared to the Federal Republic of Somalia. We, the people of the Greater Upper Nile region, shall and will declare political divorce or political independent through the exercise of the right to self-determination to determine our political destiny, socioeconomic development, cultural well being and the right to development as a new and anew political entity for socio-human development in all human spheres of endeavors to become the greatest in the northern part of South Sudan. We would remain South Sudanese and the rest shall be added once the political kingdom has been attained sooner rather than later.
We shall also call ourselves as “South Sudanese” because we shall not and will not forever subtract or negate in our demands the right to remain full pledged South Sudanese of (El-Ballad Al-Suda) or (the land of the Blacks) as it was named by an Arab explorer and geographer Ibn Batuta in A.D.1450 and by a Jewish explorer and geographer David Rabini in A.D. 1500, by the Greeks explorers and geographers that called the entire region as (Ethios) plus [pia} [people with burned faces] because we have been historically part and parcel of whole and the whole must be equal to the sum of its parts. In the Biblical studies, Sudan has been mentioned more than seven times in the Holy Bible otherwise it was known as the Cushitic in the Old Nubia.
We shall and will go because as long as Salva does not step aside the war would continue and we do not wish to kill anyone at all except the one that says that the Nuer nation and its resilient people have no right to live peacefully and to develop both socially and economically compared to any nationalities on the planet-Earth. Both Salva Kiir and Paul Malong Awan, their loyal and faithful friends and allies like Uganda of dictator Yoweri Museveni, JEM of Jibril Khalil, SSRF of Abdul Aziz El-Hilou and the SPLM/A-N of Malik Aggar as well as other hired for-money fighters from as far as Tanzania, Zimbabwe, Rwanda, Burundi and Somalia have opted that the Nuer have no right to live on the planet. We shall and we will teach a lesson that they would not forget because we too have every right like anyone else to be on this planet-Earth.
We do hope that the People’s Republic of China (PRC), as recently announced by the South Sudan FM, Dr. Bernaba Marial Bil after his recent state visit to the People’s Republic of China, would be lured into this war against the Nuers nation and it great, brave and gallant people would not exist on the planet. It would be the Chinese companies that would lose a great deal because of their demand for the black gold (oil) that is not in Juba, but in the Nuerland in Greater Upper Nile. The PRC should think twice before it can be lured into this protracted and intractable war as a superpower and permanent member state of the UN Security Council (UNSC), entrusted with maintaining and preserving international peace and security. We also call on the IGAD mediators not to allow the PRC to medal into the intractable African wars because it could easily lose its influence, prestige and interests in Africa. The PRC should remain ‘neutral’ and to deal as equal with the warring parties in South Sudan and as a loyal friend to all African peoples and should not become entangled or involved in the intractable African wars because they could damage the PRC image in Africa in the future and the present.
We urge and appeal to the IGAD mediators to call on all foreign forces to get the hell out of South Sudan’s soil because they will have no peace of minds due to constant death in the area. For our survival, we are force to fight anyone who threaten our existence and we will give them a hell of good fights until we defeat Salva Kiir because if it were not so, he (Salva Kiir) would not have imported foreign troops, mainly the UPDF mercenaries, and soldier of fortune affiliated to it from East Africa and yonder minus Ethiopia, Djibouti and the Republic of Sudan, hired into South Sudan war with the Nuer’s Petroleum revenues, to fight the Nuer . We shall and will go on our own way to determine our political destiny, socioeconomic development, cultural well being and the right to development.
We would not reckon that there would be a fight and we would be ready to pay that high price, but we shall and will neither be defeated nor surrendered. Cognizant that we are brave, courageous, resilient, motivated and determined with guts and gusto, we shall and will defeat Salva Kiir and his foreign friends and allies because the signs at the frontlines are becoming clearer in the battle fields in South Sudan. We have nothing to fear except fear itself. We shall and we will prevail in this war of aggression and genocide against the Nuers (Naadth or Nath).
Before we can really proceed with my critical and analytical analysis and objection of the proposed Prime Minister Position and the proposed conditions thereunto, I would be obliged to state it at the outset that in the present National Transitional Constitution (NTC) of South Sudan, the Prime Minister’s Position does not exist in any articles, paragraphs or clauses in the concurrent Interim Transitional Constitutional Constitution that I have termed as John Luke Joak-Makuei Lueth-Tellar Deng Ring or the trio-musketeers. Therefore, the proposed newly would-be created Prime Minister Position would become irrelevant, illusion, imaginary, hollow, deceptive, manipulative and maneuvering by the supporters of the Dinka dictator Salva Kiir–mainly- President Yoweri Museveni of Uganda, including his unnamed friends with higher stakeholders vested interests in South Sudan, including East Africa and yonder.
SHAME ON THE IGAD MEDIATORS
It is indeed Shame, Shame and shame on the IGAD mediators who proposed Prime Minister Position in South Sudan because it is powerless, irrelevant, unproductive, unprogressive and would neither provide physical and security protection for Dr. Machar’s and his Generals’ security if they should envisage or opt to return when the civil war or as if a tribal warfare concludes in the future and the present. In this acutely and aggravating situation in the war-ravaged South Sudan, the IGAD mediators duties, responsibilities and obligations should be to reckon that Genocide… as defined by the UN Convention on Genocide and adopted as the UNGA resolution 260 (III) A of 9 December 1948, Paris, France, and came to effect on 12 January 1951 has occurred in South Sudan.
Furthermore, until the IGAD mediators have exhausted every available means necessary to narrowing the gap between the warring parties on the root causes of Genocide… as the gravest and the greatest crimes against humanity as defined by the UN Convention on Genocide and the devastating crisis in Africa’s youngest failed state in South Sudan that has been now moving rapidly, feverishly and ominously from being chronically and politically instable state to becoming stateless to statelessness a clear reminiscent to the 1992 Somali experience in the aftermath of the fall of General Sayaid Bare in Mogadishu, Somalia. It has not been the primary purpose and the mandate of the IGAD mediators to exclusively appoint any political office for the people of South Sudan. The powerless proposed Prime Minister Position would become useless and hopeless because it does not have any legal and constitutional powers to provide physical security protection to anyone that opposes Salva Kiir’s kingdom of Death Valley. The Opposition would absolutely and categorically reject it and there would be no compromise on this position in any negotiated forums.
UNIMPLEMENTED DEMANDS BY THE OPPOSITION
It would be recall that the positions presented to the IGAD mediators by the SPLM-in-Op pre-requisites or pre-conditions as the roadmap to peace, conflict management, and de-escalation of the war rather than escalating it in the interim remains unfulfilled and unimplemented demands by the opposition. These conditions were as follows that: firstly, Salva Kiir to step aside or to step down from power and to turn over the state powers apparatus to the governed that all powers emanated from in all established nation-states. Secondly, the immediate and the unconditional withdrawal of all foreign troops-mainly UPDF, mercenaries and Soldiers of Fortune from all the IGAD countries less Ethiopia, Djibouti and the Republic of Sudan from South Sudan soil. Thirdly, we demand an explication that targeted the Nuer nationality or ethnicity for extermination as a “final solution” in whole or in part by Salva Kiir and Paul Malong Awan Special Militia”. Fourthly, the formation of a Transitional Government of National Unity (TGNU). Specifically and apparently, none of these suggestions or recommendations has been implemented by the IGAD mediators, thus, far that tantamount to a disastrous failure on the IGAD mediators’ peace efforts and conflict resolution in South Sudan.
The ongoing civil war or as if a tribal warfare in South Sudan has not been about the creation of powerless, useless, hopeless and dysfunctional and obfuscated Prime Minister Position. Realistically, no dignify and sensible member of the Opposition or any Nuer, Dinka, Shilluk and Equatoria nationalities in the Opposition with all their five (5) sound and normal senses and like-minds would be crazy enough about the would-be newly proposed created powerless and dysfunctional Prime Minister Position that does not exist in any articles, paragraphs or clauses in the concurrent Transitional Constitution of South Sudan. The proposed Prime Minister Position become illegal, unconstitutional, and lack substance that looks like it is a silhouette and an empty bird nest on the tree tops. It’s a total deception, manipulation and maneuvering of the third kind. It has no powers to provide physical and security protection for the Opposition members against any intimidations, extortions and harassments from Salva Kiir camp in the future and the present. So who really needs or crazy about this slippery-slope position?
HAS THE WAR BEEN ABOUT THE PRIME MINISTER POSITION?5
Succinctly, the war has not been about the Prime Minister Position, but it has been all about social justice denied and good governance by the Dinka dictator to a great majority of South Sudanese. The IGAD mediators should register at the affront that the proposed Prime Minister Position has already created sharper divisions, objections and parallelisms from both the government delegation and the Opposition camps alike. Let’s hypothetically assume that the main purpose of the proposed Prime Minister Position was to convince or to court Dr. Riek Machar’s or anyone that he may chooses to select from the Opposition to serve, would surely regards any such appointment or selection as absolutely vague, deceptive, manipulative and invalided and be declared as null and void. It’s too pretty shallow, hollow and illogical construction, baseless, groundless and redundant theoretical framework in contemporary political frame of reference (worldview), scientific, methodological, analytical legal and logical reasoning and reasonableness. Affirmatively and plausibly, no one with good sense of logical reasoning and reasonableness in the Opposition would dare to take such appointments of the Prime Minister Position that does not exist in any articles, paragraphs and clauses in the Transitional Constitution of South Sudan. It would be a real joke and a false premise and plying a highly refined sophisticated structured sequel that eventually demised the opposition ability to defeat Salva Kiir in the future and the present.
As long as Salva Kiir’s remains in power, there would be no peace, national unity and national integration and the war would not end. Other conditions already above-mentioned would also have to be implemented prior to any achievement of peace and conflict resolution in South Sudan. So South Sudanese should be prepared for war, pain, suffering and mental anguish and they should also acknowledge for more deaths ahead. The war could go on for at least five (5) years as the minimum and up to ten (10) years as the maximum. It would not be Dr. Riek Machar’s solo that would have objections on the proposed Prime Minister Position, but the entire Opposition for that. The Opposition as a whole would demand a mandate on behalf of the masses that Salva Kiir steps aside or resigns without any precondition as sin-qua-non to peace, national unity, national integration, reconciliation, forgiveness, but not to forget now rather than tomorrow if the goal and the objective would be to achieving peace in South Sudan. However, the IGAD mediators and the whole world should know that the war in South Sudan would not come to an end or to come a virtual standstill sooner than anticipated by some parties that have been lured into this longest and protracted and intractable conflict by false deception, manipulation and maneuvering because of special interests involved in this horrific human drama or epic.
SALVA KIIR HAS DESTROYED A NATION AND ITS PEOPLE
The destruction committed by Salva Kiir’s and his tribal and security henchmen has been disproportionate and astoundingly incomprehensible and decapitating with so many degrees of sadness beyond human comprehension. The IGAD mediators should acknowledge that Salva Kiir has destroyed so many lives by committing genocide (luoi naadth ke iriqqi)…as the gravest and the greatest crimes as defined by the UN Convention on Genocide and adopted as the UNGA resolution 260 (III) A on 9 December 1948, Paris, France, and came to effect on 12 January1951. By virtue of the preceded explication, the international community and the IGAD mediators in the first place should reckon that Salva Kiir is no human being with sound and responsible spirit because if it were so the case, he [Salva Kiir] could not have killed or wasted so many lives and could not under any circumstances should continue to rule or lead the country as the President of South Sudan, unfortunately.
Although I do not subscribe to the principles of the International Criminal Court (ICC) for basic reasons the I do not recognize it as legally motivated, but rather as a politically motivated Court that lack the legal substance to indict, trial and sentence any heads of state and governments or the nationalists or any frame of reference (worldview), articles, paragraphs and clauses in the UN Charter, Salva Kiir and his protégés must and ought to fact the ICC or another existing internationally de jure international tribunal such as, the International Court of Justice established under the UN Charter or the African Union Court Tribunal (AU) as a regional organization authorized under Article 52 of the UN Charter, should in effect establish an African Union Court Tribunal (AUCT) for direct involvement of African heads of state and governments referent to what the illegitimate President Salva Kiir and his henchmen have done, which they ought not to have done in what shall be known hereinafter as Juba Genocide. Let us assume that if I were to recognize the ICC as a legitimate motivated legal entity, I would have no choice, but would surely recommend or suggest pressing charges against Salva Kiir for being the co-perpetrator pursuant to Articles 25 (3) of the Rome Statute for the crimes against humanity of murder under Article 7 (1) (a); deportation or forcible transferred of the targeted Nuer nationality from their dwellings to seek refuge at the United Nations Mission in South Sudan (UNMISS) under Article7 (1) (d); rape under Article 7 (1) (g); and other inhumane acts, heinous crimes committed against humanity and other atrocities under Article 7(1) (k). We could also press further other serious charges against Salva Kiir under international law, international humanitarian laws and international human rights laws against the entire GOSS leadership that the future and the present research would adequately address through the social sciences research variables, political, legal, scientific, methodological, epistemological, sociological, philosophical and metaphysical research theories.
As we could deduce inductively from the proceedings, Salva Kiir Mayardit, Paul Malong Awan, including all their security henchmen are not rational, but irrational human beings, but as if animals and the most deadly Copra that deserved to be put in safe, tightened and the most relatively guaranteed cages or Plenipotentiary Prisons for life without paroles or they all be subjected to be hanged like the Iraqi dictator Saddam Hussein in Baghdad Prison by hanging until pronounced dead, be executed by injection with lethal vaccine or through Electro-execution. Again, although we do not subscribe to the idea of capital punishment as my Nuer Customary Laws and Criminal Procedures and Customs as a faith-based community or society and historically has been freed from the times of immemorial remained to be freed from the non-application of the capital punishment nation that has passed on this tradition from generation to the next. Basically, the introduction of the Anglo-Indian Laws into Sudan and the Nuerland in particular, precipitated or could be cited as the root causes of the thirty (30) old Anglo-Nuer War (1898-1930) and the continued résistance against the British colonial rule in the Nuerlnd and the adoption of the “Indirect Rule” developed by Lord Henry Luggard that became the standardized imperial Britain colonial policy through its Anglo-phone colonies in Sub-Saharan Africa.
The Nuer folks were also governed through the Native Administration imported from the Western Sudan’s Darfur region, but were already inexistence in the Nuerland prior to the British colonial adventure in the post-Berlin Conference (1884-1885) and th scramble for Mother Africa by the ex-imperial colonial powers in Metropolitan Europe at the time. I would surely close my eyes and just do it such that entire humanity could become free from such unwanted criminals, killers and murderers. Since I would not be the one that would pull the robs and the boxes over the holes under the gallows, I would be obliged to do it first as Pontius Pilate vs. Jesus Christ, the King of Jews, as that was the first criminal case on the planet by washing off my hands with waters for Kuoth Nhial mi midit (God Almighty) (Allah Almighty) to forgive me for the sober legal decision that I would undertake on the above-mentioned. Nevertheless, in despite of the anger and concerns of the events that have transferred and the genocide committed in by Salva Kiir’s Twic “Special Militia”. i.e. Aget Wang, Bany Adut, Malwal Anyier and Malwal Anyoul in Juba town on 16-17 December 2013, I have no doubts that in my mind nowadays they as human beings would feel remorse to have done what they have done, which they ought not to have done.
Nevertheless, the Nuer nation as a great nation, strong and thriving in all directions worldwide, it courageous people do not fear forgiving for the sake of peace. President Nelson Mandela based on his twenty-seven (27) years ordeals in prison on Robin Island off shore the Coast of South Africa for the cause of social justice, freedom, democracy, equality and peace said, he that “Courageous people do not fear forgiving for the sake of peace”. I could forgive the Twic Dinka Special Militia because they were acting under duress and personal orders of Salva Kiir and Paul Malong Awan, but I could not forgive the two, namely, Salva Kiir and Paul Malong Awan forever because they knew dawn well what the heck that they were doing with deliberate and willful intent to target the Nuer nationality or ethnicity for extermination or annihilation as a final solution in whole or in part. We shall and we will enforce the law and the time to do that is nearer and right at the corner of the goalpost. We shall and we will prevail in this drama like others before us who have experienced genocide and the Holocaust, Slavery, anti-Semitism, anti-Nuerism, social discrimination, racial segregation, Apartheid, racism and racialism worldwide. We shall and we will overcome the growing anti-Nuerism and genocide against the Nuers as a race, a nation and a nationality in South Sudan that we [Nuer] liberated with our sweats and blood such that it’s become what it is and what it should be, already completely and totally destroyed by the Dinka power elite under the tutelage of the mad and crazy Dinka dictator Salva Kiir.
He [Salva Kiir] has to step down without any pre-conditions as sin-qua-non to peace, socioeconomic reconstruction and the vital national strategic security interests. Furthermore, he (Salva) has destroyed the country, its people, its unity of purpose and of equals and does not deserve to lead it no more. He has got to go. He would have to quit per people’s power although he would leave behind a pretty ominous tragic and terrible legacy for the Dinka nationality leadership for generation of the future and the present. The IGAD mediators should know and underscore that there would be no compromise working with Salva Kiir even if there were to be new statist paradigm shift, liberal political system or democracy and a shared federal system based on self-rule and shared-rule similar to the newly proposed federal system of Kurdistan, Shiite, Sunni and Islamist State in Iraq that the US has shied off to premise in South Sudan. The denial of the proposed federal system in South Sudan by the US lawmakers’ has been hypocrisy and double standards, treacherous and a travesty to democracy, the American Constitution and the way of life.
The root causes of the ongoing civil war or as if a tribal warfare in South Sudan has been deeper than many would assume and as if it is not being handled properly, it could spillover into the neighboring countries, thus, setting up the entire region to become an international “hot spot” and “politico-military inferno”. Therefore, I propose that if the IGAD mediators and the international community are really keen and serious to resolving South Sudan conflict, they would have to support and accept without any quid-pro-quos the proposed concept of a federal system with proper power sharing arrangements, constitutional safeguards, self-rule and shared-rule between and amongst the states and the reconstruction of the devastated states socioeconomic infrastructure to under reconstruction and implementation in the country now supported and embraced by all Southerners in which each region should govern itself, manages its own socio-economic infrastructure and development, manages its own educational development and its utilization of the land use and local resources.
There should be three (3) federations in South Sudan, namely, the Greater Bar-el-Ghazel, the Greater Equitoria and the Greater Upper Nile. The creation of the Prime Minister Position for the sake of a position, would not serve the purpose, but would further renege and debilitate that purposeful intended purpose. Failure of the future and the present rounds of talks should not be blamed on the Opposition. Rather, they should be blamed on the Government delegation that is disorganized, intransigence, stubbornness, stupidity, arrogant, and the lack of courtesy, consideration, reasoning and reasonableness and seek to have everything in a silver platter instead of being partners in the search for peace and conflict resolution, reconciliation, forgiveness, but not to forget, cooperation as the way forward.
Finally, the IGAD mediators could not proceed forward only if the GOSS delegation become impartial, changes its method of rapprochement, poor judgment and imbalanced negotiations styles based on inexperience in the art of negotiations, unstructured agenda and to becoming impartial and democratic in whatsoever they do anticipate to present in their rapprochement and decision-making, thus, paving the roadmap to achieving peace and conflict resolution in this acutely and aggravating situation South Sudan. The GOSS delegation has to become pragmatic, decisive, relevant, impartial and well-balanced in their deliberations and approaches in tackling the root causes of problem that has now created serious human disillusionment, pain, suffering and mental anguish, massive internally displaced of persons (IDPs) to become internal refugees in their own country without any international adequate safeguards and protection from the UN and its specialized agencies and under the auspices of the 1953 Geneva Convention on the refugees based now set on the issue or problem placed before us.
THE WAY FORARD
Conclusively, the way forward towards achieving peace and conflict resolution would be to deal relevantly, adequately and practically with substantive issues in this compound complex civil war or as if a tribal warfare in South Sudan.
Firstly, the IGAD mediators’ the United Nations Security Council (UNSC), the good Offices of the UN Secretary-General, the intergovernmental organizations (IGOs), the NGOs, human rights watch groups, the Amnesty International (AI) and other people of goodwill, including peace research institutions in various parts of the world, they would have to bring pressure points to bear to convince Salva Kiir that it is about time to step aside for the cause of the national and region peace and security, national unity, national integration and socioeconomic strategic national security interests. There would be no alternative except for Salva Kiir to go “Now” because he cannot no longer lead or rule the people and the country that he has already destroyed and imported foreign forces to help him fighting what he termed as the rebels-a people fighting for their survival and the inalienable civil and political rights in the land of their birthrights and specifically have been targeted for extermination as a “final solution” in whole or in part by Salva Kiir’s regime in Juba, the temporary Capital of South Sudan.
Secondly, there should be immediate and unconditional withdrawal of all foreign forces- mainly UPDF and all its affiliated mercenaries and Soldiers of Fortune (SF) out of South Sudan soil, including the Justice and Equality Movement (JEM) (Tarabora) from Darfur led by Jibril Khalil, Sudan Revolutionary Front (SSRF) led by Abdul Aziz El-Hilou and Yassir Arman in Southern Kordufan and the SPLM/A-North (SPLM-N led by Malik Aggar in Southern Blue Nile (Igessena).
Thirdly, Salva Kiir has to acknowledge that Genocide… as the gravest and the greatest crimes against humanity as defined by the UN Convention on Genocide and adopted as the United Nations General Assembly (UNGA) resolution 260 (III) A of 9 December 1948, Paris, France, and came to effect on 12 January 1951 has been committed and must and ought to give an adequate and sufficient explanation to that effect when the war would end in the war-ravaged South Sudan. As I see it, Peace remains too far away in Galaxy without any proper explication by Salva Kiir and why it happens, it remains murky and no light in the tunnel, yet.
Fourthly, the proposed Prime Minister Position would become irrelevant, unproductive or counterproductive to produce tangible substantive peace formula to stop the killings, massacres and genocide between and amongst all internal diversities [ethnicities] to stop the civil war or as if a tribal warfare and to propel forward national reconciliation on genocide committed by Salva Kiir and Paul Malong Awan “Special Militia” of the Twic Dinka that shall be known to hereinafter as the 16-17 December 2013 Juba Genocide, respectively.
Fifthly, all of the IGAD countries less Ethiopia, Djibouti and Sudan should withdraw their military personnel from South Sudan without any preconditions or quid-pro-quos as sin–qua-non to the restoration of peace and national security interests. The IGAD mediators should know we have physical event to present to prove our point of argument that most of the IGAD countries participating in South Sudan peace process less Ethiopia, Djibouti and Sudan are also part of the problem rather than part of the solution. We would urge and appeal to all member states of the IGAD mediators on the panel in South Sudan peace process to withdrawal because they could not become impartial as long as their military personnel constantly and daily participate in fighting the rebels and dying and being captured by the rebel groups in the jungles of South with no probable cause to fight and to die for in the first place.
Sixthly, as a proof and justification to our point of argument and contention, to serve as a material witness, we do have identification cards from the dead and captured foreign soldiers to serve as exhibits or material witnesses to the international community. We shall not be relenting résistance until the root causes of the genocide that particularly targeted the Nuer nationality or ethnicity or a race for extermination as a “final solution” in whole or in part have been adequately explained, analyzed analytically, logically and legally satisfactorily.
Seventhly, the issue of federal system of government that Dr. Riek Machar talks about retrospect to the beginning of the crisis in South Sudan, though not new, and as recently proposed by the US in Iraq in recent weeks would have to be debated to lay out its pros and cons in preserving national unity, unity in diversity, correlation of forces, political power and resources sharing (wealth) and the security arrangements of all internal diversities, national integration, the new statist paradigm shift to liberal political system or democracy, egalitarianism and communalism in South Sudan.
Eighthly, we shall and we will reiterate that the roadmap to peace and conflict resolution would be for Salva Kiir to step aside and to face justice for all the crimes that he had committed against the state and its people or inhabitants as a whole. Precisely, Salva Kiir and company has to get the hell out of the way and they have to go now and not tomorrow.
Ninthly, Salva and his company should know that in accordance with Latin Proverb, “It is absurd that a man should rule others who cannot rule himself”. As the US General Douglas MacArthur says, “Never give an order that can’t be obeyed”. These are, of course, the basic relevant raison d’être for me to humbly suggest or recommend in the peace process, democratic and intellectual discourse and the mannerism that Salva Kiir should shape it out for the good of the country and its wholesome functioning people. We would have no other better choice than this. Rather, we would be compelled to fight him [Salva Kiir] and his foreign friends and allies until he would be disgracefully fall from the amazing grace to amazing disgrace and be kicked out of power in Juba through the people’s power.
Tenthly, for the sake of our national unity, national integration, the socioeconomic reconstruction and the vital strategic national security interests, we urge and appeal to all South Sudanese to unite their ranks and files to undergo spearheading South Sudan Spring or South Sudan Streets similar to the Arab Spring or the Arab Streets or what I call the social revolution or the social renaissance by the masses to peacefully take over the powers apparatus of the state from Salva Kiir and to get rid of the dictatorship for the sake of liberal political system or democracy and federal democracy for the general good of the majority in the state. We all shall fight back for our rights from Salva Kiiir’s dictatorship in Juba. The Nuer nation and its resilient people shall over the 2013 Juba Genocide and someone would have to pay a pretty hefty price in due course of time. As a courageous people we are not afraid to forgive our enemies, but they pay the price of their deliberate and will aggression. We want peace and not war because war, per se, is hell and destruction of lives and property. If this is what Salva Kiir and Paul Malong Awan wanted, they could have it up to their necks and we can and will deliver it much more effectively and efficiently.
We would reiterate that the IGAD mediators should keep on exerting pressure points on the negotiations and to keep on trying as hard as they know-how to stop the killings, the massacres, genocide, war crimes and crimes against humanity and to achieving the peace and conflict resolution and to bring justice to all those that have committed genocide from the president down to the common man in the streets of Juba and beyond in South Sudan for that. In as a far as we [victims] of the perpetrated genocide are concerned, we shall and we will work assiduously to make sure that no stone left unturned in the cause of social justice until Kiir’s, his protégés, tribal and security henchmen should be captured, trialed, sentenced for the international crimes that they have committed against humanity in South Sudan compared to Serbia and Croatia war crimes committed by the late Serbian President Slobodan Milosevic by the International Criminal Tribunal on Yugoslavia ( ICTY).
