South African Based Legal Expert Warns East Africa For Trying To Ban Dr. Machar From South Sudan Politics

Nov 26, 2016(Nyamilepedia) ——-  South African based legal expert on human rights and governance, Dr. Remember Miamingi, who currently teaches law at University of Pretoria – South Africa, warns East African region that any attempt to ban or isolate Dr. Riek Machar from entering the country or practicing politics in his country can only fuel conflict in South Sudan.

Speaking to South Sudan in focus, Dr. Remember warns that the recent move by Ethiopia and Sudan to block Dr. Riek Machar Teny from entering South Sudan will only incite more violence in the war-torn country.

Machar leads the largest rebel group in South Sudan, which controls nearly half of the country, however, the international community and the region are attempting to isolate Machar to “give peace a chance”.

Dr. Miamingi, a lecturer of law, warns that such attempts can only complicate the conflict.

“That feeling of unfair treatment of Dr. Riek Machar can actually play into recruiting price for people who feel the same across South Sudan and mostly people from his ethnic base” he said.

The legal expert blames USA and the international community for the latest turn of political events in “favour of a dictator” in South Sudan.

He said the move to isolate Dr. Machar was spearheaded by the U.S Secretary of State, John Kerry, and Donald Booth, the US envoy to Sudan and South Sudan.

“When John Kerry stood in Nairobi and indicated that the replacement of Dr. Reik Machar was legal and then the US Special Envoy to Sudan and South Sudan again testifying before the US congress saying that it was not wise for Dr. Riek Machar to return to South Sudan” Dr. Miamingi said.

“What one would make out of that is an American’s position on South Sudan wants to find solution to problem in South Sudan without Dr. Riek Machar” Dr. Miamingi continued.

He believes that the international community and the region are only supporting a dictator at the expense of South Sudanese people.

“For the first time, I see the region and the international community in love with a dictator” Dr. Miamingi says.

“The action of the region and the international community is doing right now, it has emboldened the government by ensuring that its intention of  silencing critique, of ensuring that South Sudanese do not speak in Kenya, in Uganda or in Ethiopia”

Government NOT implementing Peace Agreement

Dr. Remember Miaming reiterates that the government of Salva Kiir is not implementing any peace agreement in Juba.

Asked of what about Taban and his group, Dr. Miamingi argues that Taban has joined the government and no government can sign and implement a peace agreement with itself.

“By isolating the second main party to the Agreement of Resolution of the Conflict in South Sudan(ARCISS), what the guarantors of that agreement have communicated to South Sudan is that […] we do not have a peace agreement at the movement in the absence of the parties  that signed the peace agreement” Dr. Miamingi said.

“I would really cannot deny the government in Juba of the right to self delusion. They are entitled to their opinions” Miamingi continues.

“You really cannot sign a peace agreement between yourself. Taban Deng Gai is by all standards part of the government. How can a government sign an agreement with itself?”

Miamingi defends his argument that without Dr. Riek Machar and his SPLM/SPLA-IO, there is only one party to the conflict in Juba and that party is not eligible to implement a peace agreement by itself.

“The peace agreement was signed with IO, IO under Dr. Riek Machar, Riek Machar is not in Juba. If people who are part of the government of National Unity are not in Juba, how can you implement a peace agreement that do not exist?” Miamingi asks.

Miamingi, who spoke from Acra, Ghana, is a South Sudanese human rights and governance expert. He is currently based at the Centre for Human Rights, Faculty of Law, University of Pretoria, Republic of South Africa

kill yourself. we r happy with Taban. Riek is just a vampire who feeds on the blood of other pipo coz there’s no way he can defeat the government through fighting hence more fighting will only result in to more lose of lives n won’t change anything. With fighting he is giving Salva Kiir’s regime a chance to remain in power the more fighting goes on, the longer Juba regime stays
WE NEED PEACE not self interest why is it wen he is not holding a position in the government he rebels. we r tired of u taking our innocent souls . N to this websites wic promote violence by posting about warmongers like Machar, it will sad one day wen u learn that your family has all been killed through fighting caused by this selfish Machar

The truth is the professor is right.. NO NEED ELABORATING on his concern as the region is well aware of this and the American are also aware of this predicament. A chaotic South Sudan is what these vultures endorsing a very an ethical BAND on liberators and reformists to say the least. American HYPOCRACIES and the regional criminals heads of states of East Africa yielding to their criminal friend Kiir. It doesn’t get any better than that. America cant tell Kiir that he has to go because Kiir has a contract with China and China has America in her pocket financially. Nuer should and the other oppressed tribes should burn that country to the ground so everyone can have a freaken fresh start.

Again for those fools who are deprived of what I meant, in my earlier comment. Jaang and the BAN endorsers.

Machar and many NUER leaders to mentioned a few per say, from the past inspired birthing South Sudan and none of you cowards cannot denied this in person without difficulty justifying your contradictions.

Now its the same Machar you cowards are trying to discredit and the same Nuers and other oppressed tribes along with Machar you are discrediting.. Not to mention that it is a large portion of what constitute what you cowards refer to as SOUTH SUDAN… population wise and territorial wise and politically and per man power you must be kidding yourself to delusion that you have a chance either way idealistically. To disenfranchise any group, tribe or any major opposition and or a legitimate political party is to condemned South Sudan to lengthy period of uneccessary instability. South Sudan struggled for liberation togather and willingly voted for a statehood unanimously. To say today that one person , groups, or tribe doesnt deserve equal opportunity in exercising the very rights of liberty, justice, and freedom in which all South Sudanese sacrifice so much for would be absurd and discriminatory shameful.

Dr. Miamingi is deadly right about a false peace going on in South Sudan. No single party can implement peace in the absence of another. Taban Deng is a government ally since July, 2016, so without Dr. Riek Machar in Juba, South Sudan, it means collapsing of peace. NO PEACE AT ALL IN SOUTH SUDAN.

This article tell truly all about South Sudan problems. We all know that Obama administration had a hand or created the genocide in South Sudan. As a Sudanese or Nuer man from South Sudan and leave in the U.S, we know that Slava Kirr so called president of Republic of South South him and his people can not lead or defeat SPLA/IO, because they don’t have heart. We knew that the way south sudan work right now wouldn’t take us any were, even though John Kerry and Obama administration created genocide or that huge mess. We know that you cannot play politic with people who don’t understand their role to benefit. You can robs people are not educated but as a Sudanese find out later or some one explain it in the fair way? We never ever for get that, now all none educated people of South Sudan know the problem that been created by the United States of America. And non south sudaneses’s people put their hand in the Ak47, thing now is better than before, because there is No rule of law and no education or peace. This historical will be following by any Sudanese men or leader or until the U.S must do something sooner or other while you can kill all of one tribe but there is luckily one some were else is watching. Never be a useless friends for very long time, when we run out of hope. We can hire some one to plans the seed. This article tell truly all about South Sudan problems.
